General Summary:
Qualcomm Incorporated is seeking an experienced export compliance manager with strong knowledge of Taiwanese and U.S. Regulations including Taiwan’s Foreign Trade Act, US Department of Commerce Export Administration Regulations (EAR) and the US Treasury Office of Foreign Assets Regulations (OFAC) and sanctions regulations. We are looking for candidates who work independently and collaboratively.
Minimum Qualifications:
- Minimum 7 years of direct experience with Taiwan, Asia, and international export controls, sanctions, and compliance management. Experience in mobile and wireless semiconductor industry is preferred.
- Minimum of 2 years country Export or Trade Compliance Manager, with legal background is preferred.
- Minimum bachelor’s degree in legal, business, science, and/or equivalent is required.
Preferred Qualifications:
- Extensive knowledge of Taiwan BOFT regulatory guidelines, Internal Compliance Program (ICP), IVL, and ICP export bulk permit.
- Solid experiences and knowledge of EAR, OFAC Regulations, Anti-boycott rules, US ITAR Regulations, and Wassenaar dual use and munitions lists are required.
- Firsthand experience on customers and partners due diligences process development and management, commercial tools and databases evaluation and process integration are must with strong analytical and problem-solving ability.
- Strong problem solving, and communications skills and ability to multitask.
- Ability to work effectively cross functionally with colleagues, management, and operations personnel.
- Good skills with reading regulations and interpreting laws are required.
- Solid and proven experience on project management
- Ability to translate legal requirement into practical guidance and formulate creative solutions to accomplish the company’s objectives.
- Professional regulatory research, analytical and critical thinking, risk assessment, management, and process development skills are crucial.
- Experience with Trade Management Systems, Enterprise Business Solutions (Oracle, SAP preferred), Salesforce CRM, Business Intelligence tools (Oracle BI preferred) is also a plus.
- Excellent writing and communication skills in both Chinese and English is must.
- Proficient in Microsoft office applications such as Word, Excel, Visio, and PowerPoint. Flexibility to take on additional responsibilities not otherwise specified are required.
- Collaborations and participation with local export and trade industry groups a plus.
Minimum Qualifications:
• Bachelor's degree and 7+ years of Export or Sanctions Compliance, International Affairs, or related work experience.
OR
Associate's degree in Business Administration/Management, International Business, Law, Electronic/Telecom Engineering, or related field and 9+ years of Export or Sanctions Compliance, International Affairs, or related work experience.
OR
High School Diploma or equivalent and 11+ years of Export or Sanctions Compliance, International Affairs, or related work experience.
*Completed advanced degrees in a relevant field may be substituted for up to two years (Master’s = one year, Doctorate = two years) of work experience.
Principal Duties and Responsibilities:
- Monitor, analyze, and report on any change of Taiwan trade control, sanction, and related regulations. Translate any related documents and regulations from Chinese to English and English to Chinese for Qualcomm internal groups and/or Taiwan licensing authorities as needed.
- Monitor, analyze and comply with the regulatory requirements of foreign countries for export to Taiwan especially any change or update from U.S. which may impact on Qualcomm due diligences (DD) processes.
- Routinely look into or evaluate opportunities to reduce human errors on DD, and/or increase efficiency and productivity by any notion such as utilize commercial tools and databases.
- Continuously develop and update Qualcomm Taiwan Internal Compliance Program (ICP) and Standard Operating Procedures (SOPs) according to change of regulations, businesses, and related export compliance procedures to ensure total compliance.
- Prepare and/or update all Taiwan related export compliance training materials, train the trainers, and deliver the trainings as needed to any applicable member of senior leadership team and/or employees.
- Timely prepare, submit, and follow up with any export compliance related classifications, screenings, license applications, and/or reporting requirements as needed in Taiwan. Maintain all export compliance related records and provide to the corporate export compliance team as needed.
- Work closely with Qualcomm external suppliers, customers and internal business groups and liaisons to coordinate and ensure any export compliance requirements will be timely and accurately satisfied.
- Initial troubleshooting on any system or interface at fault from export compliance perspective and timely communicate it with export compliance system and/or IT support teams.
- Prepare and develop Taiwan related export compliance audit plans, communicate it with the business units, conduct the audits, prepare the audit reports, and follow-up on any corrective actions as needed.
- Travel within Taiwan to cover support for multiple Qualcomm Taiwan offices. Periodic travel to other countries.
- Perform denied party screening of business partners in China and Hong Kong using the Trade Export System (TES) and due diligence evaluation tools, e.g., Dow Jones, Kharon, Sayari, etc.
- Review and process export control assurance forms.
- Perform Military End User/Use (MEU) screening on business partners from China and Hong Kong
- Analyze MEU findings to determine if further action is required.
- Determine targeted questions to follow up with business partner based on the MEU findings.
- Research using Chinese websites and use Chinese search engines.
